By accessing and using Song Surprise ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Service Description

Song Surprise provides custom song creation services. We create personalized songs based on information and stories provided by our customers. The final product is delivered as a digital audio file via email.

3. User Responsibilities

When using our Service, you agree to:

• Provide accurate and truthful information
• Not submit content that is offensive, defamatory, or violates any laws
• Not infringe on any third-party rights (copyright, trademark, privacy, etc.)
• Use the Service only for lawful purposes
• Not attempt to gain unauthorized access to our systems

4. Payment and Pricing

• All prices are in USD and subject to change without notice
• Payment is required before song creation begins
• We use Stripe as our payment processor
• All sales are final once the order is confirmed
• Rush delivery fees are non-refundable

5. Delivery

• Standard Delivery: Within 3 days of order confirmation
• Rush Delivery: Within 24 hours (additional fee applies)
• Songs are delivered via email to the address provided during checkout
• Delivery times are estimates and not guaranteed

6. Refund Policy

We offer refunds under the following conditions:

• Full refund if we fail to deliver your song within the promised timeframe
• Full refund if you are not satisfied with the final product (one revision included)
• Refund requests must be made within 3 days of receiving the song
• No refunds after you have approved the final version

7. Intellectual Property

Your Rights

Upon full payment, you receive a personal, non-exclusive license to use the custom song for personal, non-commercial purposes. You may share the song with family and friends, play it at private events, and post it on personal social media accounts.

Our Rights

Song Surprise retains all rights, title, and interest in the musical composition and recording. We may use your song for promotional purposes unless you request otherwise.

8. Content Ownership

You retain ownership of any stories, memories, or content you provide to us. By submitting content, you grant us a license to use it solely for the purpose of creating your custom song.

9. Revisions

• One revision is included with each order
• Revision requests must be submitted within 3 days of receiving the song
• Additional revisions may be subject to additional fees
• Major changes to the story or theme are not considered revisions

10. Limitation of Liability

Song Surprise shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid for the Service.

11. Warranty Disclaimer

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

12. Indemnification

You agree to indemnify and hold Song Surprise harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We reserve the right to terminate or suspend access to our Service immediately, without prior notice, for any reason, including breach of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
